Terms of Use

MEASUREALL edits and offers, through its software solution developed for mobile devices (smartphones and tablets), functionalities for making measurements based on construction plans (the ’App«).

The App is primarily aimed at building professionals as well as individuals who wish to measure lengths, lines, surfaces, volumes, angles, and roofs (the ’User«).

1. Scope - Enforceability

These General Terms of Use or End User License Agreement («Terms») define the terms and conditions for the use of the App's features by the User.

Use of the App and the User's acceptance of the T&Cs by checking the box «I accept the T&Cs» imply full and complete acceptance of the T&Cs and their application to any future use of the App, the User acknowledging to have read them in their entirety.

The User guarantees that they have full authority to accept these Terms and Conditions, either on their own behalf or on behalf of the legal entity they represent.

The GTC may be amended at any time, without notice, particularly depending on changes made to the App's functionalities or any evolution of the regulations.

Use of the App will be subject to full and complete acceptance of any new version of the T&Cs.

2. Accessing and Installing the MEASUREALL App

Access to the App requires the User to have a compatible mobile device (smartphone only), i.e., with Android® and iOS operating systems, and an Internet connection.

Access and installation of the App are subject to the following restrictions:

Terminal restrictions apply:

  • iPhone: from iPhone 5S
  • Smartphones Android:
    • We do not guarantee the compatibility of the application with mobile phones manufactured before 2013, although the application does operate on older mobile phones.
    • Generally, we recommend a screen size of 4 inches (10.16 cm) or larger.
    • The App version is compatible with these devices at the time of its publication. However, in the event of certain manufacturers introducing new models with innovations that may impact the display and use of the App, we cannot guarantee that our application will remain compatible with them, although we are working to ensure that our application remains compatible with new versions of Android and iOS devices.

Operating System Restrictions:

  • Android from version Android 6.0 (API level 23)
  • iOS from version 11

The app version is compatible with these operating systems at the time of its publication. However, in the event that certain device manufacturers decide to discontinue support or modify certain features of Android or iOS operating systems, or if there are changes to the operating system itself, we cannot guarantee that our application will remain compatible with them, although we are working to ensure that our application remains compatible with new versions of Android and iOS operating systems.

The app is available for free download from the «Apple Store» and «Google Play» platforms.

Once installed, the User will be able to use the App, in compliance with these T&Cs.

The App's software version may be periodically updated to add new features and new services, or to modify or suspend certain services, without prior notice. The unavailability of the App during these events does not entitle the User to any compensation.

3. MEASUREALL App Features

The App is a software tool for calculating, displaying, and storing the following measurements from the elements described below:

For the «Lite» version, which is free

The App allows for the following measurements (hereinafter the «Measurement(s)»):

  • Dimension measurements
  • Perimeter measurements
  • Surface measurements

For the «Pro» version, requiring a subscription

  • For the walls:
    • Measurement of area or net areas of walls from points entered by the User and the height provided by them.,
    • The linear elements on the ground corresponding to these surfaces are algebraically cumulated.
  • For floors:
    • Surface area measurement or algebraic surface accumulations from points placed by the User,
    • The corresponding linear elements for these surfaces are algebraically summed.
  • For the structural work:
    • Measurement of volume or algebraic sums of volumes from points placed by the User for a floor area and the height entered by the latter,
    • The corresponding floor areas for these volumes are therefore cumulatively added algebraically.
  • For Roofing:
    • Roof angle measurement from points placed by the User,
    • Measurement of roof surface areas or algebraic sums of roof surfaces from points entered by the User and the angle provided by them, or by using an already measured angle.,
    • The corresponding linear elements for these surfaces are algebraically summed.

Based on these measurements, the User can, using plans in Portable Document Format, commonly abbreviated as PDF (open format ISO 32000-1:2008 PDF or ISO 32000-2 PDF 2.0 standard), previously downloaded; ;

  • Determine the dimensions, perimeters, and elementary horizontal areas.,
  • Perform quantity take-offs for walls, floors, structural work, and roofing, with the ability to subtract or add certain elements such as door surfaces, windows, bathtubs, skylights, etc.,
  • These measurements can be used to develop verifiable quotes or place material orders outside of the application.

Outside of (i) downloading and installing the App and (ii) downloading PDF files, the App can be used completely autonomously, without internet access.

The App does not use any of the mobile device's geolocation features.

Each Measurement can be saved and archived using a customizable title (file name); this backup file is shareable and can be read by any spreadsheet software or text editor.

When performing a Measurement, we do not do any geolocation and no data transfer is performed.

Measurements are subject to the authenticity, quality, and reliability of the data provided by the User. The Measurements are for informational purposes only and do not replace a study conducted by a specialized professional.

They are obtained from a synthesis of the methods available at the date of entry into force of the GCU for the calibration and measurement of a virtual document and cannot reflect the completeness of possible methods.

Measurements may be subject to a margin of error in the range of 0.1 % to 5 %. This margin of error is a typical value observed when measurements are taken in accordance with the «Recommended Conditions of Use»; it does not constitute a firm commitment regarding performance or results.

In the case of measurements outside of «Recommended Conditions of Use,» measurements may be subject to a larger margin of error.

The Recommended Conditions of Use are as follows

  • Use a terminal with a screen size of 5 inches (12.70 cm) or more, and with a resolution of 720x1280 or more.,
  • When scaling, select an object of known size and maximum size (5m or more) on the plan,
  • To set the points during scaling and zooming in on the plan as much as possible,
  • Take measurements, excluding roofs, for elements 1 meter or larger on house plans.,
  • Conduct roof measurements for surfaces of 20 m² or more, from a top-down view, with known angles, and angles exceeding 10°.

However, it should be noted that, in general, measurements taken with the App on standard house plans yield very satisfactory results.

4. Intellectual Property

4.1 MEASUREALL or third-party rights. The App, the name MEASUREALL, and all content (graphic elements, illustrations, animations, videos, texts, data, architecture, know-how, source codes in particular) are protected by intellectual property law and are the exclusive property of (or licensed to) MEASUREALL or any designated third party.

Consequently, the User may not, in any way, reproduce, represent, distribute, or license all or part of the elements of the App, without the express prior agreement of the rights holders or without respecting the license conditions for these rights.

The violation of the aforementioned rights may constitute infringement punishable by the provisions of the Intellectual Property Code and/or a tortious act that may engage the civil liability of the infringers.

4.2 License Agreement. We grant the User a personal, non-exclusive, revocable, non-assignable, non-transferable, worldwide, and royalty-free right to use the App solely for their own needs in connection with using the App, to the exclusion of any other purpose.

No other intellectual property rights are granted to the User on the App, the name MEASUREALL, or its content.

The usage license ends in case of deletion of the App by the User or by MEASUREALL, in the latter case, without prior notice or compensation.

5. Liability – Warranties

As part of using the App, Users are asked to download the Plan(s) necessary for the App to function (« User Content »).

The responsibility for the reliability, integrity, or quality of all User Content rests with the User.

It is the User's responsibility, in particular, to upload one or more Plans in the aforementioned PDF format, correctly scanned or photographed.

The App is designed to correct the following errors in drawings created from the digitization of paper plans:

  • Paper plane rotations before scanning,
  • Uniform and homothetic zooms when digitizing paper plans,
  • Or the combination of these two deformations.

However, User Content must comply with the following conditions to be processed by the App and produce results.

User Content must not be affected by:

  • A rotation greater than +/- 30° from the horizontal,
  • A uniform and homothetic zoom dividing the dimensions by a factor greater than or equal to 5,
  • A uniform and homothetic zoom multiplying the dimensions by a factor of 10 or greater.

On the other hand, User Content resulting from these transformations, and in particular the parts on which the User must take action, must be clearly visible to the User.

For any deformation other than a rotation or a uniform homothety zoom, for example deformations that affect the document non-uniformly, deformations induced by a document plane not parallel to the scanning plane, etc., User Content may not be processed by the Application and may not give rise to Measurements.

We shall not be held liable for (i) the non-exhaustive, erroneous, or incomplete nature of User Content, (ii) non-compliant actions in the event of incomplete, erroneous, or incomplete User Content being provided, or (iii) direct or indirect damages, including loss of profits, incurred by the User related to the interpretation of the Measures.

We are committed to making our best efforts to ensure 24/7 access as long as it is available on mobile app download platforms.

By way of exception, the App may be temporarily unavailable during maintenance operations necessary for the proper functioning of the App and in the event of an occurrence beyond our control.

We are free to choose the appropriate format and means to make all of the App's functionalities available to Users.

Our responsibility is excluded in the event of unavailability of the App, absence of updates, occurrence of bugs, display or download errors, or lack of speed of the App.

We shall not be held liable for external intrusions, the presence of computer viruses in the User's system, any consequences of total or partial alteration of the App's functionality due to misuse or hacking of the App, or the loss or absence of backup of the Measurements.

We cannot be held responsible for any interruption or failure of our providers' telecommunication services.

The app in its «Lite» version is offered for free.

The app in its «Pro» version is offered to the User for a fee at a price of €2.99 per month (including tax) or €29.99 per year (including tax).

However, we do not commit to the perpetuity of this rate and reserve the right to subsequently modify its pricing principle by notifying the User of this pricing change, who may then choose whether or not to continue using the App under the new terms.

The User expressly agrees to (i) download the App for personal and non-commercial use, (ii) not sell, rent, sublicense, or otherwise distribute the App and/or its content to third parties, (iii) not implement any systems likely to hack the App and/or its content in whole or in part, or that would violate these Terms and Conditions, (iv) inform Us immediately upon becoming aware of any hacking activity, and in particular any illegal or non-contractual use of the App and/or its content, regardless of the distribution method, and (v) not to adapt, modify, translate, transcribe, arrange, compile, decompile, assemble, disassemble, transcode, or apply reverse engineering to all or part of the App, its functionalities, and/or its content.

6. Personal Data

The data may be used by MEASUREALL's marketing and communications department for the purposes of contact, sending commercial or promotional offers exclusively from MEASUREALL, sending satisfaction surveys, and conducting statistics, provided that you have expressly consented to this.

We are committed to retaining all personal data collected through the App and not sharing it with any third parties (with the exception of Measures, which may be shared, in a confidential and aggregated manner at the municipal level, after a minimum period of one year necessary to verify the reliability of this data).

By way of derogation, the User is informed that We may be required to communicate the personal data collected to authorized administrative and judicial authorities, solely upon judicial order and, for exclusively technical reasons, to the App's services ensuring the processing of data.

In accordance with regulations, the User benefits from a right to access, rectify, and delete information concerning them, which they can exercise at any time by accessing their profile.

The User may also object, if applicable, for legitimate reasons to the processing of their data by filling out the contact form available at: https://measureall.app.

7. Assignability

MEASUREALL may freely assign or transfer the App and/or all or part of the rights and obligations arising from the execution of the App to any third party of its choice, without needing to obtain the User's authorization.

8. Language – Applicable Law – Competent Court

The official language of the Terms of Use is French.

In case of translation, only the French version of the Terms of Service shall prevail.

The terms and conditions are governed by and subject to French law.

Failing an amicable agreement within THIRTY (30) days of notification by one party to the other party of the existence of a dispute, any disputes that may arise between the Parties concerning the conclusion, performance, interpretation and/or termination of the GTC shall be submitted to the competent courts of RENNES (France), including in summary proceedings, multiple defendants or warranty claims.

Furthermore, in accordance with Articles L. 612-1 to L. 612-5 of the French Consumer Code, any consumer has the right to free access to a consumer mediator for the amicable resolution of any dispute with a professional. To this end, MEASUREALL guarantees the User effective access to a consumer mediation system.

The User is nevertheless informed that the dispute may only be examined by the consumer mediator if they can justify having previously attempted to resolve their dispute directly with MEASUREALL by a written complaint sent by registered letter with acknowledgment of receipt, and that this complaint has not been successful or has remained unanswered within a period of two (2) months.
